A report in the Mail on Sunday regarding a Court of Appeal decision stated that applications for masts could now be blocked on health grounds.
The actual decision was taken during a case concerning the Education Dept and it stated that ... "Appeal Panels had to keep the guidance issued by the Sec of State in mind, but it was not direction, and did not lay down rules to be strictly adhered". The guidance had to promote the statutory purposes and since Oct 2 2000, had to be Convention compliant. This differs from the Mail on Sunday report, but the decision in itself is still helpful to mast appeals.
